The annual report of the Courts Service shows there was a 29pc reduction in the number of personal injury cases being heard by the High Court last year when compared with the previous year. The figure excludes medical negligence cases. When compared with 2021, the number of cases is down 50pc. The fall has been attributed to the introduction of the Judicial Guidelines a number of years ago when judges agreed to recommended award levels in personal injuries cases that are up to 40pc lower than previous guidelines. Some of the highest awards are made in the High Court. Insurers have long argued that they will pass on lower premiums to policyholders if court award levels for personal injuries cases fall. They cases are often referred to as “slips and trips”. The Alliance for Insurance Reform said lower settlement amounts were producing savings for insurers but these savings were not being passed on to businesses and consumers. Both the Central and Circuit Criminal Courts experienced an increase of 7% in new cases last year, the Courts Service 2023 annual report shows. Courts Service chief executive Angela Denning said that the appointment of 24 new judges has had an instant impact, reducing backlogs and waiting times. The new appointments also supported initiatives such as the Planning and Environment Court and administration associated with the Assisted Decision-Making (Capacity) Act 2015, she said. The number of cases finalised increased by 10% in the Central Criminal Court and 5% in the Circuit Court. Waiting times down Chief Justice Donal O’Donnell in his foreword to the report said: “This increased throughput reflects further progress in alleviating waiting times which had built up during the years of the pandemic. ” The Central Criminal Court volume of cases on hand remains 61% higher than in 2019, with a 56% increase in new cases in 2023 in comparison with 2019. The report looks at the average and median award values made by the Board across motor claims, public liability and employer liability claims between January – June 2023. While the Personal Injury Guidelines have been the subject of much debate since their introduction in 2021, the Supreme Court in Delaney v Personal Injuries Assessment Board, has confirmed that they are here to stay. The report for the first half of 2023 provides some helpful insights on trends observable in personal injury claims in Ireland and looks at whether the Guidelines are contributing to a reduction in litigated claims. Award value For the first time, the Board has included the average and median award values in its report. According to the report, the average award value has fallen from €23,877 in 2020 to €17,248 in the first half of 2023. This represents a 28% drop in the average awards value under the Personal Injury Guidelines when compared to awards made under the Book of Quantum. Interestingly, in the first half of 2023, the Board reported an increase in the number of assessments in the moderate and severe injuries categories of the Guidelines.
